This course is run over 1.5 days and covers the key areas of Medical Law.

Programme:

DAY ONE
Morning session: CLINICAL NEGLIGENCE
Afternoon Session: CONSENT TO TREATMENT

The duty of confidentiality to patients and research subjects

10.00 - 10.45 DATA PROTECTION AND ACCESS TO RECORDS
Who can access medical records. Circumstances in which information can be withheld.

10.45 – 11.00 Coffee

11.00 - 12.45 EMPLOYMENT LAW ISSUES
Supervising juniors
Support and responsibility for colleagues
The duty of confidentiality owed to colleagues.
Whistle-blowing
Writing reports and references
Issues of discrimination in employment

Philip Fennell is a Professor in Law in Cardiff Law School, University of Wales, College of Cardiff, where he teaches Medical Law and European Community Law.

He is a member of the Law Society's Mental Health and Disability Committee and was a member of the Mental Health Act Commission from 1983-1989. He has published many articles on law and psychiatry.

He is an editor of Butterworths Medico-Legal Reports, and is honorary legal adviser to Wales MIND. He also writes the Annual Review of Medical Law cases for the All England Law Reports (Butterworths), and is author of the Health and Social Services chapter of Cross's Encyclopaedia of Local Government Law (Sweet and Maxwell). He is co-author of Gostin and Fennell, Mental Health: Tribunal Procedure (Longman) 1992 and his book entitled Treatment Without Consent: Law, Psychiatry and the Treatment of Mental Disorder since 1845, was published by Routledge in 1996.

He has recently lectured on the Human Rights Act 1998 to the judiciary on behalf of the Judicial Studies Board.
